Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve <br />Bond Release Application No. 2 (SL-2) for the Yoast Mine, Permit No. C-1994-082. The mine is <br />operated by Seneca Coal Company, LLC under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act of 1979. The bond release application was submitted by Seneca Coal Company, LLC <br />on August 31, 2007. Seneca Coal Company is requesting release of Phase I bond liability on 515.8 acres <br />of its total 2,318.3 acres within the permit boundary at the Yoast Mine. The Phase I Bond release request <br />is for disturbed acres in the North Pit, South Pit, and Neck Pit areas. Reclamation backfill and grading for <br />which bond release has been requested was conducted from the beginning of mining, in 1996 through <br />July 2007. Of the 515.8 acres requested, the Division of Reclamation, Mining, and Safety is proposing to <br />release 456.7 acres from Phase I bond liability. The Division will not be releasing 59.1 acres due to <br />erosion and instability including: 1.81 acres for the YPM-13 postmine drainage channel, 36.23 acres for <br />the YPM 6-2 and YPM-7 watershed areas, 14.77 acres for the YPM-8 watershed area in the Neck Pit, <br />1.1 acres for the temporary Diversion 14A which has yet to be reclaimed, and 3.18 and 1.97 acres for <br />Topsoil Stockpiles B and C, respectively where both topsoil stockpiles have remaining topsoil in them <br />and have not met backfill and grading requirements. A Self-Bond in the amount of $5,200,000 is <br />currently in place of which $790,205.00 is being released. The affected area is located in Routt County, <br />approximately 7 miles Southwest of Hayden, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the <br />Hayden Public Library. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
