(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1977-'117 <br />INSPECTION DATE: 5J96/in INSPECTORS INITIALS: RK <br />OBSERVATIONS <br />The Division conducted an inspection of the site as part of sites to be inspected during <br />the fiscal years 2009-2010. The site is a small 6.10 acre clay mine located approximately <br />5 miles east northeast of Colorado City. Present during the inspection was Mr. Matt Welte <br />of Summit Brick and Tile. Site was active at the time of the inspection. An excavator, <br />front end loader and a dozer were actively mining and removing material during the <br />inspection. Approximately 5 acres the permit area was presently affected. High walls <br />extending North to South measuring approximately 5-10 feet were noted. High walls were <br />table. Permit sign and boundary markers were properly posed. <br />Along the south side of the permit area, the land owner is developing 365 acre rancheets. <br />In anticipation of the development, the operator Summit Brick and Tile is in the process <br />of submitting an amendment to covert thello permit into a 112. <br />Mr. Joe GAGLIANO, a consultant for the operator is working on the amendment application. <br />In lieu of the pending submittal of the amendment, the financial warranty will not be <br />recalculated at this time. <br />The current warranty for the site is $36,700.00, which would have been reevaluated given <br />the extent of the pit high walls and associated disturbances. Operator was notified to <br />stay within the existing permit and affected boundary, until a revision is approved to <br />the permit. <br />A small amount of processed clay stockpile was noted along the North side of the active <br />mining area. In addition to the clay, the contractor for the pit was also removing some <br />of the sandstone slabs. <br />Since there was no problem sited during the previous inspection of7/26/2006 and because <br />the min is going to be converted into a 112, the Division will address the financial <br />warranty at that time. The topsoil. Growth medium was that was noted along the North side <br />of the active mining area was found in good repair.
