(Page 2) <br />MINE ID # OR PROSPECTING ID #: M-1977-491 <br />INSPECTION DATE: 5126/1 INSPECTORS INITIALS: 1_ <br />OBSERVATIONS <br />The Division conducted an inspection of the site as part of sites to be inspected during <br />the fiscal years 2009-2010. The site is a very small 9.9 acre clay mine located within <br />the City Of Pueblo Co. <br />Present during the inspection was Mr. Matt Welte, of Summit Brick and Tile. Site was not <br />active at the time of the inspection. According to mat, the only activity at the site in <br />addition to some remedial actions along that was required along the East side that <br />buttressed the access road to the residents in the area, and removal of material from <br />already stockpiled clay ...no additional mining had taken place on site. <br />The entire site is fenced, and permit sign is posted on the access fence to the property. <br />Approximately 5 acres appeared to have been affected since the permit was issued. Most of <br />the affected area, along the East, west and North side the pit slopes have been <br />reclaimed. No major sign of erosion features noted. The entire site was walked and <br />inspected No major noxious weed infestation noted. <br />Operator has in place a noxious weed infestation plan as required. The entire permit area <br />was walked and inspected, topsoil pile properly protected and stable along the South East <br />side of the pit area. <br />The permit allows the operator to be less than 200 feet of the manmade structures, manly <br />the road which is the road located along the East side. The pit slopes along the area <br />were found to be in good repair. Operator does not plan to mine in this area any time <br />soon and if mining takes place in the future, which does not appear likely in this area, <br />because the active mining area is along the south west and south side. The high walls <br />along the North and East side have a height of approximately 5 to 6 feet and do not <br />appear to be stable. Unlike the slopes to the North West and west side, these slopes have <br />not been cut to a 3:1 or gentler final reclamation slope. Even though no 200 feet set <br />back is granted under the current approved plan for these residential roads, operator is <br />aware and in the event mining starts will not be any closer than noted at the time of the <br />inspection. <br />The current warranty for the site is $6,500.00 which is deemed adequate to cover the <br />current disturbance. Mining appears to be conducted at this site as the need arises, <br />given the need for the type of color of clay that is mined at the site, according to Mr. <br />Welte.
