STATE OF COLORADO
DIVISION OF RECLAMATION, MINING AND SAFETY
Department of Natural Resources
1313 Sherman St., Room 215
Denver, Colorado 80203
Phone: (303) 866-3567
FAX: (303) 832-8106
February 16, 2010
Mr. Jim Haskins
Area Wildlife Manager
Division of Wildlife
6060 Broadway
Denver, CO 80216
Re: Peabody Sage Creek Mine (C-2009-087), Mine Permit Application
Division of Wildlife Comment Letter of August 27, 2009
Dear Mr. Haskins:
COLORADO
D I V I S I O N OF
RECLAMATION
MINING
SAFETY
Bill Ritter, Jr.
Governor
James B. Martin
Executive Director
The Division of Reclamation, Mining and Safety (DRMS) forwarded your letter of August 27, 2009 to
Sage Creek Coal Company, LLC, the operator of the proposed Peabody Sage Creek Mine.
DRMS received an updated mine permit application package on January 25, 2010. The package included
updated mine permit application pages that responded to DRMS's own technical adequacy comments and
the comments in your letter. Enclosed are copies of pages from the updated package that relate to your
comments. Although our preliminary review of those pages has found that your previous comments are
adequately addressed, we ask that you verify that your previous comments have been resolved.
Please note that the updated mine permit application package reflects a mine plan that is reduced in scope
compared to the originally submitted mine permit application. The updated mine plan is a room-and-
pillar mine that would not remove coal pillars, which suggests minimal or no mine subsidence. The mine
operator may at a future time apply for a mine permit revision for a longwall mine if room-and-pillar
mining indicates favorable economics.
The deadline for the DRMS to issue a decision approving or denying the mine permit application is
March 15, 2010; therefore, we ask that you respond within this timeframe.
If have questions or need additional information, please contact me.
Sincerely,
Tom Kaldenbach
Environmental Protection Specialist
cc (via email, w/o attachments):
Dan Hernandez, DRMS
Janet Binns, DRMS
Vern Pfannenstiel, Peabody Energy Corporation
Office of Office of
Mined Land Reclamation Denver • Grand Junction • Durango Active and Inactive Mines
C20 07 ?a7
