Page 2 of 3 <br />6.3.4 EXHIBIT D - Reclamation Plan <br />Weed control methods are required to be used for all noxious weeds on site. A generic plan to control all <br />noxious weeds should be included in all permit applications. If a specific noxious weed species appears in the <br />future, the plan may need to be modified to deal with that particular species at that time. <br />The reclamation costs are still under review at this time. Your estimate appears to be well prepared; however, <br />the division is required to complete a separate bond estimate as well. Once the remaining adequacy issues have <br />been addressed, this will be completed. <br />6.3.5 EXHIBIT E - Map <br />The Site Maps need to depict the access route to the pit from County Road 3 referred to in Exhibit D, statement <br />d). Access routes are considered affected area and must be included in the 9.9 acres permitted. <br />Thickness of replaced overburden/topsoil should be included on the reclamation maps where it will be replaced. <br />6.3.6 EXHIBIT F - List of Other Permits and Licenses Required <br />Adequate as submitted. <br />To date, no comments have been received from other agencies that DMG solicits for comment on new <br />applications. If any are received between now and the decision date that require your attention, they will be <br />forwarded to you. One agency that you will need to contact is The Water Quality Control Division of the <br />Colorado Department of Health and Environment to determine whether or not you will be required to obtain <br />storm water permits for you sites. <br />6.3.7 EXHIBIT G - Source of Legal Right-to-Enter <br />Adequate as submitted. <br />6.3.8 EXHIBIT H - Municipalities Within a Two-mile Radius <br />Adequate as submitted. <br />6.3.9 EXHIBIT I - Proof of Filing with County Clerk <br />Adequate as submitted. <br />6.3.10 EXHIBIT J - Proof of Mailing of Notices to Board of County Commissioners <br />and Soil Conservation District <br />Adequate as submitted. <br />6.3.12 EXHIBIT L - Permanent Man-Made Structures <br />DRMS has noted the waiver allowing the mining activity within 200' of the county roadways. However, what <br />the rule requires (6.3.12 (a)) is a notarized agreement between the Applicant and the County (structure owners) <br />stating that the Applicant will provide compensation for any damages to structures within 200'of the permit <br />boundary.
