L' <br /> 1. The Division proposes to grant Ksmall area exemption5from use of sediment <br /> ponds due to the limited size of the area and due to the fact that ponds and <br /> treatment facilities are not necessary for the drainage to meet the effluent <br /> limitations of Rule 4.05.2 and applicable State and Federal water quality standards <br /> for receiving streams and also due to the fact that no mixing of surface drainage <br /> with a discharge from underground workings will occur. The small areasto be <br /> exempted is located at the topsoil pile at pond 007 (4.05.2(3)(b)(l)). <br /> B. Acid-forming and Toxic-forming Spoil <br /> 1. The Division proposes to approve temporary storage of acid- and toxic-forming <br /> spoil for more than 30 days. This decision is based on a finding that burial or <br /> treatment of these materials within 30 days is not feasible and the delay will not <br /> result in any material risk of water pollution or other environmental damage <br /> (4.05.8(3)). See Section 2.04.6 for identification,mining plan contingencies, and <br /> spoil mine soil reconstruction plans (respectively) that address acid or toxic spoil <br /> horizons. <br /> C. Ground and Surface Water Monitoring <br /> 1. The applicant will conduct monitoring of ground water in a manner approved by <br /> the Division (4.05.13(1)). The ground water monitoring plan is as follows: <br /> a. The baseline data gathering program (New Horizon 2 - July 1986 to July <br /> a Q 1987) took monthly static water levels and quarterly water quality samples in <br /> January. April, July and October. Results are discussed and tabulated in <br /> Section 2.04.7 of the permit application. <br /> b. Mine 1: All wells in the area will be monitored on a monthly basis for water <br /> levels and adjusted to MSL. Water Quality parameters will be collected and <br /> analyzed on an annual basis. <br /> c. Mine 2: All wells in the area will be monitored monthly for water levels <br /> adjusted to MSL and samples will be collected on a semi-annual basis for <br /> water quality parameters. <br /> 2. The applicant will conduct monitoring of surface water in a manner approved by <br /> the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iii) and <br /> includes the following: (4.05.13(2)) <br /> a. The baseline program (New Horizon 2 - July 1986 to July 1987) included <br /> monthly visits to maintain, service, take flow measurements, take field <br /> parameters and collect full suite water quality samples. Results of this <br /> program are discussed and tabulated in Section 2.04,7 of the New Horizon 2 <br /> permit application. <br /> 16 <br />
