AFFIDAVIT OF PUBLICATION DAILY RECORD State of Colorado County of Fremont I, the undersigned agent, do solemnly swear that the CANON CITY DAILY RECORD is a daily newspaper published in the City of Canon City, County of Fremont, State of Colorado, and which has general circulation therein and in parts of Fremont, Park and Chaffee Counties; that said newspaper has been continuously and uninterruptedly published for a period of more than six months next prior to the first publication of the annexed legal notice of advertisement, that said newspaper has been admitted to the United States mails as second-class matter under the provisions of the Act of March 3, 1879, or any amendments thereof, and that said newspaper is a daily newspaper duly qualified for publishing legal notices and advertisements within the meaning of the laws of the State of Colorado; that a copy of each number of said newspaper, in which said notice of advertisement was published, was transmitted by mail or carrier to each of the subscribers of said newspaper, according to the accustomed mode of business in this office. TA4e FEE $ 30.30 JUN 0 9 2010 P,Kming and Shy NOTICE OF PROPOSED DECISION The Colorado Division of Reclamation, Mining and safe- ty purposes to Approve Technica I Revision Application No. 1 (TR-1) for the Northfield Mine (Permit No. C-2006 085 ), surobmitted by Northfield Partners; LLC.The appli- cant pposes to shift the portal location 450 feet to the the North and proposes to add a second ventilation shaft. These changes do not add additional disturbed area. The Northfield Mine is an underground coal mine locat- ed in Fremont County, approxi46t4?§7 as south of i Canon City. Coal interest is Private, and the surface ' affected is Private land. The permit area encompasses approximately 1,157.00 acres. This proposed decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S.; and the regulations promulgated thereunder. I Copies of the proposed decision, including stipulations, are on file for public inspection at the Colorado Division of Reclamation, Mining and Safety, Room 215, Centen- nial Building, 1313 Sherman Street, Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made. within ten (10) days of the initial publication of this notice; must be in writing, and must state with reason- able specificity the reasons for the request and the objections to the proposed decision.
