III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the inspection. Comments also <br /> describe any enforcement actions taken during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Rob Zuber of CDRMS. The mine no longer extracts coal,but the remaining <br /> surface pit (Pit B) is permitted to dispose of flyash. The weather was warm and breezy. The mine site was dry throughout <br /> the site;the most recent precipitation was 6/100"on May 29,2010 per Don MacDonald of Coors Energy Company. Present <br /> at the inspection was Don MacDonald. <br /> Roads: The access and haul road to Pit B are in good condition and well graded. No problem areas were identified on the <br /> roads. <br /> Hydrologic Balance: Sediment Pond #2 and the B Pit contained pools of water. The embankment for Sediment Pond N2 <br /> was inspected and no rills,gullies,burrow holes or other problems were observed. Some Cottonwood and Russian Olive <br /> trees are growing in the embankment but do not appear to be a problem. <br /> i <br /> it <br /> Inlet from west and embankment Spillway and trees on embankment <br /> Topsoil: Topsoil piles were inspected and no problems were detected. Most of the sides of the piles were well vegetated. <br /> CEC staff indicated that the piles south of the office/shop were last disturbed in October 200& <br /> General Mine Plan Compliance: CEC is awaiting a survey of the proposed pad extents by the gas company. <br /> CEC continues to dispose of ash in Pit B. CEC will continue to place ash on the lower lift until they reach the northern <br /> extent of the B pit. During the inspection a scraper pushed an ash load into the pit. No problems were observed with the pit <br /> or the ash disposal area. <br /> Fish&Wildlife: A lone coyote was observed running east of the B Pit. <br /> Air Resource Protection: A water truck was on site at the B Pit, and Mr. MacDonald indicated that it is used often, <br /> especially when the ash is dry as it was on June 3, 2010. <br /> Reclamation Success: <br /> No rills or gullies were observed at the site.
