Rd. 21 <br />Haxtun, CO 80731 <br />June 5, 2010 <br />Division of Reclamation, Mining and Safety <br />1313 Sherman Street, Room 215 <br />Denver, CO 80203 SUN 0 S Z??? <br />RE: New 112 Application ??n;rag <br />Masters Pit #2 <br />Dear Sir or Madam: <br />I am forwarding an application on behalf of Elva Masters. of Anton, CO for a <br />mining permit for a regular 112 mining operation. Ms Masters has posted the site. <br />Copies of the application have been provided to the County Clerk, County <br />Commissioners, and the local Soil Conservation Board. Notice to adjoining <br />landowners and public notice for the newspapers will be sent after you deem the <br />application as complete. <br />Ms. Masters opened Masters Pit #1 (M-2009-029) last spring. When mining <br />actually began, the original configuration did not work efficiently for getting <br />material into trucks, so we filed Technical Revision #1 which was approved. It <br />kept the same acreage but simply re-shaped the area. After using that <br />configuration for several weeks, the decision was made that it was still not the <br />most efficient and workable solution. At that time I filed a second Technical <br />Revision, which again proposed no change in acreage, but simply made it easier <br />to mine. Based on the response to the first Technical Revision, we assumed the <br />second change proposed was not substantial and would be approved. We would <br />like to apologize for jumping the gun and making an assumption. Ms. Masters <br />had no intent of violating her permit. After she was found in violation we <br />discussed a variety of options to remedy the situation. We feel the best alternative <br />is simply to open the entire 80 acres as a pit and mine it in small segments, so that <br />the financial assurance can be limited to only those areas open. <br />I realize that her violation is being taken before the board on June 9. Please let <br />this application show her good faith effort to correct the situation. We appreciate <br />your willingness to work with us and making things right.
