Pineda <br />_ Director = --- <br />RE: Westhoff Pit; DRMS File No. M-1977-094; Follow-up on Unresolved Problems <br />Dear Mr. Westhoff, <br />The above-mentioned site has had one or more problems noted that, according to Division of <br />Reclamation, Mining and Safety (Division) records have not yet been resolved. According to our <br />records, the following problem was to be resolved on or before April 30, 2010. Listed below are <br />descriptions and corrective actions for the problem. Please resolve the corrective actions and <br />provide evidence of such resolution on or before June 30, 2010. <br />Please note that if the corrective action(s) are not properly addressed, and evidence provided to <br />the Division by the date provided above, the listed problems could be escalated to the level of <br />possible violations and would then be referred to the Mined Land Reclamation Board for further <br />action. <br />Problem Description: <br />• The Reclamation Plan fails to address how final grading of the site will be done to control <br />erosion and siltation of the affected lands, to protect areas outside the affected land from <br />slides and other damage as required by Rule 3.1.5(3). <br />Corrective Action: <br />The Operator shall submit a Technical Revision describing how final grading the-site---- --1 <br />will control stormwater runoff as it enters the drainage channels. The Technical Revision -'' <br />shall include a map, with contour lines, depicting the final grade of the site. The <br />Technical Revision shall describe how stormwater runoff will be routed into both of the <br />drainage channels that leave the mine site.
