A signed waiver and consent agreement between the landowner and <br />Dorchester granting rights to conduct surface coal mining operations within <br />300 feet of the landowner's occupied dwellings presented Exhibit 2, Ownership <br />Information. This agreement has been assigned to EFCI as provided for in the <br />original terms. <br />2.03.8 PERMIT TERM INFORMATION <br />All underground mining, and coal processing activities, ceased in late <br />December 2000, and EFCI filed for permanent cessation of operations in August <br />2001. EFCI has submitted information within this application covering the <br />entire mine plan area encompassed by the permit boundaries. Areas permitted <br />and affected by mining are shown in Table 2, Affected Areas for Mining and <br />Reclamation. <br />The existing approved permit expires on July 30, 2004. Application for a <br />fourth 5-year permit term under the existing permit has been filed, with DMG <br />review and approval pending. Only reclamation activities are anticipated for <br />this and subsequent permit terms. <br />2.03.9 PERSONAL INJURY AND PROPERTY DAMAGE INSURANCE INFORMATION <br />A current certificate of insurance has been filed with the DMG and a copy is <br />included within this application as Exhibit 3. Certificate of Insurance, as <br />evidence that EFCI has a public liability insurance policy in force for the <br />Southfield Mine. The insurance policy meets regulatory requirements for <br />minimum coverage, will be maintained in full force during the permit term and <br />all subsequent renewals, and includes a rider ensuring notification to the <br />DMG of and termination or substantive changes in the policy. <br />2.03 - 39 Revised 5/13/04 <br />Permit Renewal RN-04 <br />
