<br /> THIS PERbIIT is issued this 'Alst day of Augusl 19-76
<br /> by the Land Reclamation Board, Department of Natural Resources, State of Colorado.
<br /> W I T N E S S E T H
<br /> M1EREAS, Col owyo Coal Company ( General Partnership of Gracoal�Inc. an
<br /> Western Hanna, Inc. )
<br /> desires to operate an open mine, known as Colow.yo Strip , for the purpose of
<br /> extracting Coal ; and,
<br /> 1•11ERLAS, the Land Reclamation Board has received an application and
<br /> reclamation plan and map, a fee and a bond or security for such operation as
<br /> required by law: and,
<br /> WIECRIAS, the Land Reclamation Board has made a finding;, for the purposes
<br /> of issuing this permit, that the method of operation, physical appearance, and
<br /> timetable are reasonable in view of the public interest in physically attractive
<br /> surroundings and completion of the operation as soon as practicable; and,
<br /> WIMIU AS, for the purposes of issuing this permit, the operator has made
<br /> a satisfactory sho-wing to the Board that his operation will not adversely affect
<br /> the stability of any man-made structure on the area of the affected land and
<br /> within two hundred feet of all boundaries of such area; and,
<br /> WHER AS, for the purposes of issuing this permit, the operator has made
<br /> a satisfactory showing to the Board that he will employ during and after his open
<br /> mining operations procedures reasonably designed to minimize as much as practicable
<br /> -the disruption from the open mining operations and will provide for the rehabilita-
<br /> tion of any such surface resources adversely affected by such open mining; operations
<br /> -through the rehabilitation of plant cover, soil stability, water resources, and other
<br /> measures appropriate to the subsequential beneficial use of such mined and reclaimed
<br /> lands; and that in the event of the failure of his proposed reclamation plan, he
<br /> will take whatever measures which may be necessary in order to assure the success
<br /> of reclamation of the lands affected by his open mining operations; and,
<br /> WHEREAIG, for the purposes of issuing this permit, a copy of the applica-
<br /> tion approved by the Land Reclamation Board of the State of Colorado is attached
<br /> to this permit and thereby becomes a part of the terms hereof.
<br /> 1TCW TIIEREFORE, Pursuant to the authority set forth in the Colorado Open
<br /> Mining Land Reclamation Act, Article 32 of Title 34, C.R.S. 1973, as amended, the
<br /> Land Reclamation Board of the State of Colorado hereby issues a permit to
<br /> Colowyo Coal Company to engage in open mining for the purpose
<br /> of extracting Coal on the following parcel of ground: Those portions
<br /> of Sections 22, 21, 26 27, 28 13, 14• T 4 North, Range 9� W. and those portions of
<br /> Sections 2, 3, 41, 9, 10 and 11; T I North,- R 93 West as indicated in Exhibit A
<br /> Amendment.
<br /> This permit is issued subject to all requirements of the Colorado Open Mining Land
<br /> Reclamation Act and all rules, regulations and standards now in force and ally which
<br /> may in the future be promulgated by the Land Reclamation Board, and this permit may
<br /> be revoked or suspended for non-compliance with uc rules, re s and standards.
