The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The inspector noted on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTIVE ACTIONS <br />CORRECTION <br />DATE <br />1 An appropriate mine identification sign was not observed at the Level 2 or Level 3 areas. <br />Permit boundary markers were not observed for any of the three permit areas. 10 /01/10 <br />PB or PV: PB <br />CORRECTIVE ACTION: Within 30 days of the date by which the Operator satisfies the TOPIC(S): SM <br />corrective actions of Violations MV-2009-035 and MV-2010-001, post appropriate mine - - <br />identification signs and permit boundary markers in accordance with the requirements of Rule <br />3.1.12. The Operator may not post mine identification signs or permit boundary markers until <br />receiving written notice from the Office clearly stating that the Cease and Desist Orders for <br />Violations MV-2009-035 and MV-2010-001 are lifted. <br />2. As shown in photos one through five, the Operator has inappropriately stored materials and <br />has partially obstructed Little Deadwood Creek with mining debris at Level 2. 06 /18/10 <br />PB or PV: PB <br />CORRECTIVE ACTION: Within 10 days of the signature date of this report, by TOPIC(S): HB <br />June 18, 2010, submit a written plan describing how inappropriately placed materials and - - <br />inappropriately placed mine debris will be removed from Little Deadwood Creek and <br />relocated to appropriate areas for storage. Within five days of receiving written approval <br />from the Office for the written plan, remove the inappropriately placed materials under the <br />direct supervision of Office staff. No work may occur in the absence of direct supervision of <br />Office staff. <br />The Operator has constructed a new portal located outside of the approved permit <br />boundary. Area of off-site affected lands did not exceed 0.25 acres. The Office believes <br />that by failing to amend the permit, to incorporate the new portal prior to constructing the <br />portal, the Operator has violated the conditions of his own permit, has failed to protect off- <br />site areas from damage and/or has engaged in an unpermitted mining activity. Pursuant to <br />C.R.S. 34-32-124(1), 34-32-123 and/or 34-32-116(7)(h), the Office has scheduled the <br />possible violation for consideration by the Board, to occur during the July 14-15, 2010 Board <br />meeting.
