The problems should be corrected by the dates given, or they will become possible violations. The possible violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTIVE ACTIONS CORRECTION DATE 1 An appropriate mine identification sign was not observed at the Level 2 or Level 3 areas. Permit boundary markers were not observed for any of the three permit areas. 10 /01/10 PB or PV: PB CORRECTIVE ACTION: Within 30 days of the date by which the Operator satisfies the TOPIC(S): SM corrective actions of Violations MV-2009-035 and MV-2010-001, post appropriate mine - - identification signs and permit boundary markers in accordance with the requirements of Rule 3.1.12. The Operator may not post mine identification signs or permit boundary markers until receiving written notice from the Office clearly stating that the Cease and Desist Orders for Violations MV-2009-035 and MV-2010-001 are lifted. 2. As shown in photos one through five, the Operator has inappropriately stored materials and has partially obstructed Little Deadwood Creek with mining debris at Level 2. 06 /18/10 PB or PV: PB CORRECTIVE ACTION: Within 10 days of the signature date of this report, by TOPIC(S): HB June 18, 2010, submit a written plan describing how inappropriately placed materials and - - inappropriately placed mine debris will be removed from Little Deadwood Creek and relocated to appropriate areas for storage. Within five days of receiving written approval from the Office for the written plan, remove the inappropriately placed materials under the direct supervision of Office staff. No work may occur in the absence of direct supervision of Office staff. The Operator has constructed a new portal located outside of the approved permit boundary. Area of off-site affected lands did not exceed 0.25 acres. The Office believes that by failing to amend the permit, to incorporate the new portal prior to constructing the portal, the Operator has violated the conditions of his own permit, has failed to protect off- site areas from damage and/or has engaged in an unpermitted mining activity. Pursuant to C.R.S. 34-32-124(1), 34-32-123 and/or 34-32-116(7)(h), the Office has scheduled the possible violation for consideration by the Board, to occur during the July 14-15, 2010 Board meeting. Official notice of the possible violation and Board Hearing will follow. PB or PV: PV CORRECTIVE ACTION: Attend the July 14-15,2010 Board meeting and comply with TOPIC(S): MR the Board's decision.
