May Day Mine <br />M-1981-185 <br />June 3, 2010 <br />Photo 10 <br />Unpermitted mine <br />portal, recently <br />constructed outside of <br />the approved permit <br />boundary. The recent <br />excavation undermines <br />the access road to the <br />May Day Level 3 (Lamb) <br />and the Incas Mine, <br />Permit No. M-1986-076. <br />The Incas Mine is a <br />110d,(DMO), utilizing <br />designated chemicals, <br />including cyanide. <br />Access to the Incas <br />Mine is essential, not <br />only for the permit <br />holder, Deadwood <br />Gulch Mining Company, <br />but also for DRMS to <br />conduct routine <br />monitoring inspections <br />and for emergency <br />response. <br />.W ilk <br />Road to May Day Level <br />3 and Incas Mine, <br />recently undermined by <br />the construction of the <br />unpermitted portal. <br />Note DRMS vehicle on <br />road. The portal is <br />v?y approximately. 90 feet <br />under the road. <br />Excavation of the portal <br />.' has.over-steepened the <br />road embankment to <br />•, <br />near-vertical. As'shown <br />in the photo, the road is <br />underlain by <br />fy. _ unconsolidated earthen <br />materials. Evidence of <br />the Operator's attempt <br />to stabilize affected <br />Y lands and safeguard the <br />stability of the road was <br />not observed. <br />- _4
