(Page 2) <br />MINE ID # OR PROSPECTING ID # M-1981-185 <br />INSPECTION DATE 4/30/10 INSPECTOR'S INITIALS WHE <br />OBSERVATIONS <br />This inspection occurred as part of the Division's review process of the amendment application (AM-01) for the <br />May Day Mine, and to verify compliance with the Cease and Desist Orders for Violations MV-2009-035 and MV- <br />2010-001. This report is accompanied by four photos. <br />On December 10, 2009, the Board issued Violation MV-2009-035 for failure to comply with the conditions of the <br />reclamation permit. The Cease and Desist Order for Violation MV-2009-035 prohibited all mining related activities <br />with the exception of relocating 5,000 cubic yards of ore materials from an underground stope to the portal pad <br />at the Level 1.area. A subsequent Cease and Desist Order for Violation MV-2010-001 was issued on March 5, <br />2010. The second Cease and Desist Order did not include any exception and as of March 5, 2010, all mine related <br />activities at the May Day Mine are prohibited. <br />The site was dormant, no activities were observed. Evidence of mining activity occurring since the Division's latest <br />inspection (April 8, 2010) was not observed. The operation appeared compliant with the Cease and Desist Orders. <br />The Level 2 portal was partially obstructed by rock fall and snow. Standing water was observed in the Level 2 <br />portal, possibly associated with seasonal snow melt. Little Deadwood Creek, located nearby, was flowing. <br />The illegal portal at Level 1 has collapsed. Portions of the illegal mill have been buried by debris. The collapse has <br />obstructed the permitted portal at Level 1. A photo of the permitted. portal, taken April 8, 2010, is enclosed to <br />illustrate the extent of collapse. The Division informed MSHA of the failed portal on May 3, 2010. The application <br />for AM-01 must be amended to address the failed portal and describe how the failed portal will be repaired. The <br />decision date for AM-01 is July 5, 2010. <br />The yellow conex container, located immediately adjacent to the mill facility, contained three 55-gallon barrels of <br />metallurgical processing chemicals. The labels indicated that the contents were Flomin C 3505 Collector <br />(potassium amyl xanthate), Flomin F 672 Frother and Flomin C 7245. The Division has classified potassium amyl <br />xanthate to be a designed chemical. Official notice of this designation and the classification of the operation as a <br />Designated Mining Operation will follow under separate correspondence.
