Approval of the amendment means Colorado Stone is in compliance so far with the Mined Land <br />Reclamation Board (MLRB) Board Order, MV-2009-023 and 024 respectively. All approved structures <br />must be constructed and as-builts submitted to DRMS by August 31, 2010 to complete the compliance <br />as directed. <br />As noted, DRMS is accepting the reclamation liability estimate provided by Lewicki and Associates of <br />$78,250.00 (rounded up) Once DRMS receives as-built information a more precise calculation can be <br />done which may adjust the liability up or down based on final configuration. CS4 needs to submit the <br />additional $23,250.00 in bonding required immediately so that the amendment goes into effect and <br />work can begin as soon as possible. <br />The amendment received an objection from the adjacent landowners. DRMS notes the issues raised <br />appear to have been addressed or are not within its jurisdiction.
