CONDITIONS FOR APPROVAL
? The proposed operation does not anticipate exposing groundwater. Therefore, exposure of ground
water must not occur during or after mining operations. If stormwater is contained on-site, it must
infiltrate into the ground or be released to the natural stream system within 72 hours, or all work
must cease until a substitute water supply plan, or augmentation plan approved by water court, is
obtained. Reclamation plans must ensure water will not be retained onsite for more than 72 hours
unless an augmentation plan approved by water court is obtained.

? Prior to approving a well permit, the applicant must conduct a field inspection of the site and
document the locations of all wells within 600 feet of the permit area. The applicant must then
obtain a waiver of objection from all well owners with wells within 600 feet of the permit area or
request a hearing before the State Engineer.

COMMENTS: The mine owners have a court decreed water rights and augmentation plan, Case No.
06CW91. This decree allows the diversion of up to 1.0 cfs from the Idaho Mill Diversion, conditional
storage rights in Wildcat Augmentation Ponds #1 and 42 (3.0 and 2.5 acre-feet storage respectively), and
the Idaho Mill Settling Pond (1.5 acre-foot). The augmentation plan allows the stored water in the Wildcat
Augmentation Ponds to be released to the La Plata River for augmentation purposes. If there is a river call
and insufficient water remains in the augmentation ponds for replacement, all diversions will cease and the
project will use recycled water from the Idaho Mill Settling Pond. The Division 7 Office and the District 33
Water Commissioner will monitor all diversions and replacements to the La Plata.
