Sage Creek Mine 11/18/2009 <br />Initial Evaluation of Subsidence Impacts for Continuous Miner Development <br />• (D) A detailed description of subsidence related phenomena predicted to occur <br />within the permit and adjacent area; <br />(E) The angle -of -draw predicted to be characteristic of the permit and adjacent area; <br />and <br />(F) Appropriate maps, prepared according to the standards of Section 2.10, <br />showing: <br />(1) Any existing subsidence features which exist within the permit and <br />adjacent area; <br />(II) The extent of the proposed mine workings; <br />(III) The ground surface areal extent of an area determined by the projection <br />of the angle of draw, if predicted pursuant to Section 2.05.6(6)(e)(i)(E) or 45', <br />if no prediction is made by the applicant, from the limits of the proposed mine <br />workings to the ground surface; and <br />(IV) The areal extent of predicted subsidence related phenomena within the <br />permit and adjacent area. <br />(ii) A detailed description of material subsidence damage or diminution of reasonably <br />foreseeable use of structures and renewable resource lands which could result from the <br />occurrence of subsidence related phenomena predicted in accordance with Section <br />2.05.6(6)(e)(i)(D) within the permit and adjacent area, including consideration of the <br />following: <br />• (A) Material subsidence damage means, with respect to structures, changes which <br />make it technologically or economically infeasible to promptly restore the affected <br />structures to the condition they would be in if subsidence had not occurred. <br />(B) Material subsidence damage means, with respect to renewable resource lands, <br />changes which disrupt an aquifer, or a recharge area to an aquifer, which serves as <br />a beneficial use of water or changes which make it technologically or economically <br />infeasible to restore the productivity of the affected renewable resource lands, <br />expressed in terms of food, fiber or forage, to the level it would be if subsidence had <br />not occurred. <br />(C) A determination of diminution of reasonably foreseeable use of structures or <br />renewable resource lands within the permit and adjacent area which shall consider <br />the capability of those structures and lands, before and after subsidence <br />occurrence, to support those uses described in Section 2.05.6(6)(b)(i)(A), giving <br />consideration to factors such as soil and foundation characteristics, topography, <br />vegetative cover, surface hydrology and groundwater hydrology. <br />(iii) If the subsidence survey determines that no material damage or diminution of <br />reasonably foreseeable use could result in the event of subsidence predicted to occur <br />within the permit and adjacent area, and the Division concurs with that conclusion, the <br />application shall include a subsidence monitoring program designed to determine the <br />accuracy of the subsidence prediction required by Section 2.05.6(6)(e)(i)(D). <br />(iv) If the subsidence survey determines that material damage or diminution of reasonable <br />foreseeable use could result in the event of subsidence predicted to occur within the permit <br />and adjacent area, or if the Division determines that such damage or diminution could <br />F <br />
