Any important environmental resources <br />information would be included in the western Federal coal leases with appropriate coal lease <br />stipulations. <br />4. As required by Rule 2.04.3(2)(a), please add a narrative to this section that supports land <br />uses for the current and western expansion permit areas. Please include the relevant <br />narrative from pages 2, 3 and 4 of Section 2.04 of the Bowie No. 1 permit application. <br />BRL - The land use narrative was expanded. Pages 2.04-1, 2, 3, 4, & 7 are enclosed. <br />5. Please update Section 2.04.3(4), if appropriate, if Delta County now has land use <br />regulations that apply to the Bowie No. 2 Mine and to the transferred permit area of Bowie <br />No. 1. <br />BRL - Via e-mail dated May 25, 2010, Dave Rice, Senior Planner with Delta County notified BRL <br />that no review of PR-12 will be necessary at the County level. Page 2.04-7 was amend to <br />indicate Delta County does have specific development regulations. <br />Section 2.04.4 Cultural and Historic Resources Information <br />6. Section 2.04.4(1) was revised to include the 2004 Grand River Institute report. However, <br />there appears to be additional information in Section 2.04.4 of the Bowie No. 1 permit <br />application that might apply to the transferred permit area. Please add the applicable Bowie <br />No. 1 cultural and historic resource information to Section 2,04.4(1) of the Bowie No. 2 <br />permit application. In addition, the Division understands that the 2004 Grand River Institute <br />report covers the east side of the transferred area since BRL anticipates surface <br />disturbance from the construction of gob vent boreholes. If surface disturbances will occur <br />on the west side of the proposed transferred area, BRL will need to cite the applicable <br />cultural and historic resource surveys or perform such a survey. <br />BRL - Additional cultural resource studies will be performed in lieu of using the older reports from <br />the Bowie No. 1 Mine. <br />Section 2.04.5 General Description of Hydrology and Geology <br />7. Concerning revised page 2.04-12: <br />a. Please amend the list of maps in the second paragraph to include Map 8A. <br />b. In the 3" paragraph, 4th line, the relative directions of the streams should read "west, <br />east, central and south respectively" rather than "west, central, east and south <br />respectively". Please correct this sentence. <br />c. The following sentence (according to Map 9) should refer to the West Fork of Terror <br />Creek, rather than West Terror Creek. <br />d. The direction of flow of ephemeral drainages in the western portion of the permit area is <br />incorrectly described in the 5 sentence of the 3"' paragraph. Ephemeral drainages <br />instead flow to the east into Terror Creek and to the west into Stevens Gulch. "Stephens <br />Draw" heads the list of drainages that flow to the North Fork. This drainage does not <br />appear to be labeled on Map 9, but it does appear on other maps (5 and 6) as "Stevens <br />Draw". Please correct the spelling as appropriate and label the drainage as such on Map <br />9.
