bm /< <br />Request for Modification of Board Order <br />Pikeview Quarry <br />IM-1977-211 <br />Notice of Violation MV-2009-012 <br />Continental Materials <br />May 27, 2010 <br />Attn: Mr. Tony Waldron <br />Division of Reclamation, Mining and Safety <br />Department of Natural Resources <br />-131.3_Sherman-St.,Room215 <br />Denver, Colorado 80203 <br />Dear Mr. Waldron, <br />Castle Concrete/Continental Materials would like to request an appearance in front of the MLRB for the <br />purpose of discussing a modification of the above referenced board order issued 6/11/2009. As part of the <br />order, a Cease and Desist Order was put into effect until May 13, 2010 or approval of the amendment to be <br />submitted to the Board. <br />In section 31 of the Notice of Violation, The Board referenced the following Rule in their order stating in <br />Construction Rule 2.1.5(3) the grading must be done in a manner to control erosion and protect areas outside <br />the affected land from slides. Also, if not eliminated, all high walls must be stabilized. <br />Castle Concrete / Continental Materials was granted an extension of the submission of the amended plan <br />during the May MLRB monthly meeting. As you know, this extension was allowed to permit Castle Concrete <br />additional time in the formulation of a new mining and reclamation plan amendment. The primary reason for <br />this extension is that Castle Concrete has not been able to stabilize the remaining high walls so that the <br />investigative process can continue. <br />Castle Concrete would propose the order be modified to allow for some blasting, removal and processing of <br />material as it pertains to the investigative process of formulating the new amendment. <br />Castle Concrete has provided the DRMS and CGS with monitoring information on a monthly basis since the <br />monitoring system has been in place. Substantially more investigation must be done prior to formulating a new <br />plan but some blasting and removal of material must be done during this investigative process. Castle Concrete <br />will be submitting a formal Technical Revision outlining this process for DRMS approval. <br />Respectfully Submitted, <br />M. L.
