<br />3. Pond 004 is an approved postmine permanent impoundment. The office of
<br />State Engineer approved the permanent impoundment request
<br />demonstration in a memorandum to Colorado Division of Reclamation,
<br />Mining and Safety dated July 12, 2006. The CDRMS approved the
<br />permanent impoundment demonstration as part of TR -37 in a decision
<br />dated September 12, 2006.
