The Office of State Engineer approved the permanent impoundment request in a memorandum to CDRMS dated August 31, 2006. The CDRMS approved the permanent impoundment demonstration as part of TR -37 in a decision dated September 12,2006. 4) The impoundment re- design report presented in Exhibit 2.05.3 -E2 and this re- design drawing provide for a combination spillway structure in accordance with Rule 4.05.9(2)(a) (i) of the Regulations of the Colorado Mined Land Reclamation Board for Coal Mining.
