• REMEDIAL COMPLIANCE PLAN
The existing spillway configurations are inadeauate for a permanent impoundment.
Therefore, Peabody proposes the following remedial actions to be implemented pending CMLRD
approval:
1. Replace existing 24" CMP with a proposed 24" CNP with anti -seep collar to the
line and grade as shown on Exhibit 7 -18.
2. Replace existing v-shaped emergency spillway with proposed trapezoidal channel
as depicted on Exhibit 7-18.
3. Raise the embankment to the line and grade as shown on Exhibit
4. Install a fence to maintain safe access to the impoundment area.
U
All material excavated from the spillway and adjacent areas, as a result of the above
remedial action, will be placed in one of the following locations as determined by
Peabody's field engineer during construction:
1. If the engineer determines the material to be suitable for embankment material,
the material will be placed and compacted within the slopes of the embankment.
2. If the material is excessive or not suitable for use within the slopes of the
embankment, the material will be placed outside the plane of the slopes on the
downstream side of the embankment, graded into the surrounding topography, and
reclaimed in accordance with Peabody's reclamation plan. This excessive
material will increase the stability of the embankment by increasing the
overall width, flattening the downstream slopes, and /or reducing the downstream
embankment height. Based on the field conditions encountered at the time of
construction, the field engineer is allowed enough flexibility to dispose of the
material in an acceptable manner.
Embankment reconstruction will be conducted in compliance with CMLRD regulations. The
existing embankment will be cleared of all organic matter prior to the placement- -)f new
fill material. The placing and spreadina of fill material will proceed `rom the lowest
point on the embankment in horizontal layers of such thickness as to allow for a minimum
compaction of 93 percent of the standard proctor. Fill material will be free , -•f sod,
large roots, vegetation matter, coal or coal processing waste, and frozen material. 'oth
the upstream and downstream slopes of the embarkment_ will be 3h:ly or flatter. r!•e
completed embankment, surrounding disturbed area, ,ind ,-mergency pillr,av areas wil. s,e
seeded and revegetated to prevent erosion.
NOR 006578
M
14
A
