III. COMMENTS-COMPLIANCE <br /> Williams Fork Mines C-198 Pg 1/2 - <br /> 20 May 2010 <br /> Below are comments on the inspection. The comments include discussion of observations <br /> made during the inspection. Comments also describe any enforcement actions taken <br /> during the inspection and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection of the Eagle Mines conducted by Jim Stark of <br /> CDRMS. Joe Shoemaker of BTU-Empire accompanied me on the inspection. The <br /> mine is currently in temporary cessation and is only performing maintenance and <br /> monitoring activities. The mine is used for training for employees at the Foidel Creek <br /> Mine. The inspection was conducted on the afternoon of 20 May 2010. The weather <br /> was warm and partly cloudy and the ground was dry. The Williams Fork River, which <br /> runs along the north and east side of the train loadout, was running a bit higher than <br /> its winter flow but had not left its bank. <br /> Availability of Records: The records were brought to the inspection in three-ring <br /> binders by Joe Shoemaker (they are stored at the Foidel Creek Mine in Oak Creek, <br /> CO). Please see the DBMS Availability of Records form at the end of this inspection <br /> for more detailed information. <br /> Signs and Markers: - All of the necessary signs were in place as required. The west <br /> and east entrances along Colorado Highway 13 all have the appropriate signs. <br /> Stream buffer zone (and buffer zone exemption) signs were also in place as required <br /> along the Williams Fork River. All of the topsoil piles inspected had the proper <br /> signage, as required. Disturbance markers were in place. All of the Mine's ID signs <br /> need to be changed to reflect the mine's name change (to the Williams Fork Mines), <br /> which was approved with Minor Revision 48. <br /> Roads: - The mine access road is a gravel road. The access road was dry and <br /> appeared to be well maintained and stable. There were no ruts or erosional <br /> problems noted on the road. <br /> - The roads on the east side of the mine were all well maintained at the time of the <br /> inspection. There were no ruts or erosional problems noted on the roads on the East <br /> side of the mine (east of Hwy 13), <br /> Hydrologic Balance: - The Mine 5 dewatering ponds, 5-P5, 5-P6 and 5-P7, all <br /> contained water at the time of the inspection. The ponds were discharging at the <br /> time of the inspection (from the outfall from Pond 5-P7). The pond discharge was <br /> clear. The pond embankments were well vegetated and stable and no erosional <br /> problems were noted. <br /> - Sediment Ponds 5-P1 and 5-P2, just north of the warehouse/shop building, were <br /> both dry at the time of the inspection. The pond embankments were well vegetated <br /> and stable and no erosional problems were noted on the pond embankments. <br />
