Permit No. C-1981- <br />019 <br />Dear Mr. Stark, <br />Colowyo Coal Company, L.P., Colowyo Mine, is submitting a request for Phase I <br />and II Bond Release in certain areas of the 1993-2003 reclaimed areas. Colowyo is <br />requesting a total of 494.20 acres be Phase I Bond Liability released. This acreage <br />represents areas in the East Pit, West Pit and Section 16. Colowyo is requesting a <br />total 432.70 acres be Phase II Bond Released. This acreage also represents areas <br />in the East Pit, West Pit and Section 16. <br />All Phase I areas have been backfilled and graded according to Division <br />requirements and meet all of the other conditions for Phase I Bond Release. <br />All Phase II areas have been backfilled, graded, topsoiled and seeded in <br />accordance with the Division's guidelines and Colowyo's approved reclamation plan. <br />Colowyo has also demonstrated in this application that vegetation in the Phase II <br />areas supports the post-mining land use and meets the approved success standard <br />for cover. In addition, Colowyo has also demonstrated that revegetation in these <br />areas will result in lesser sediment contribution to surface runoff when compared <br />with pre-mining levels. <br />For the Phase I areas, Colowyo is not requesting a monetary reduction in its bond, <br />only a liability release for those areas. For Phase II areas, Colowyo is requested a <br />reduction of it bond, in the amount of $2,197,198. This calculation is an estimated <br />based Exhibit 13 of Colowyo's current permit. Specific bond information and <br />references can be found in Section 1 of the bond application. <br />Included in this application are copies of all notice letters and mail receipts to the <br />applicable parties identified in Rule 3.03.2(1). A copy of the required public notice is <br />also included, which will be published in the Craig Daily Press. Upon receipt of the <br />Affidavit of Publication, a copy will be forwarded to the Division.
