U <br />Re: Mask Ranch LLC <br />Dear Ms. Waldron: <br />The owners of Mask Ranch LLC forwarded to me your letter of April 30, 2010 requesting that <br />because they have exposed ground water due to a gravel pit that they either have an <br />augmentation plan or approval from Division of Water Resources acknowledging compliance <br />with CRS 37-90-137(11). <br />I am enclosing a copy of the well permit issued by the Division of Water Resources for this <br />gravel pit. In speaking with the water engineer, Steve Harris, he infc)rmed me that he was of the <br />opinion that the well permit should satisfy your request. <br />The San Juan River, which the gravel pit is located off of, is not on call, and there would be no <br />need to have an augmentation plan. Because the river is subject to appropriation,' if necessary, a <br />new water right could be filed. I have been unable to connect with you via telephone, and I <br />would appreciate it if you could let me know whether the well permit satisfies your requirement. <br />If not, I will discuss what to do next. <br />Yours T , <br />James .
