Page 4 <br />Mining attempts to address the corrective actions of Violations MV-2009-035 and <br />MV-2010-001. Pursuant to Rule 1.4.1(8), the Office conducted a preliminary review <br />of the submitted materials and on March 25, 2010, informed Wildcat Mining that the <br />application for AM-01 was incomplete for the purposes of filing. In that March 25, <br />2010 correspondence, the Office enumerated nine filing deficiencies. The Office <br />received additional application materials on March 31, 2010 and on April 5, 2010. <br />On April 6, 2010, the Office determined AM-O1 complete for the purposes of filing. <br />On April 28, 2010, the Office informed Wildcat that AM-O1 was a complex application and, <br />pursuant to Rule 1.4.1(7), had extended the Division's decision date from May 6, 2010 to <br />July 5, 2010. In that April 28, 2010 correspondence, the Office enumerated 28 adequacy <br />deficiencies which must be addresses to the Office's satisfaction before the Office can <br />approve AM-01 by September 1, 2010. <br />Summary of May 13, 2010 Board Hearine and Resultine Board Order <br />Idaho Mill, File No. M-2006-069 <br />1. The 180-day deadline set in the Board's December 10, 2009 Order for Violation MV- <br />2009-033 is extended by one day to June 9, 2010. This matter will be set on the Board's <br />June 9, 2010 Board agenda either for the Division's request to set this matter for forfeiture of <br />the financial warranty or to advise the Board that Wildcat Mining has obtained the Division's <br />approval of the permit application for the Idaho Mine, File No. M-2010-003. <br />2. (A) By June 9, 2010, Wildcat Mining is required to obtain the Division's approval of the <br />permit application the Board required in its December 10, 2009 Order, incorporating the road <br />into an approved reclamation permit. <br />(B) If Wildcat Mining obtains the Division's approval of the permit application by June 9, <br />2010, the Division shall not issue the Idaho Mine permit until Wildcat Mining has corrected <br />the pending violations concerning the May Day Mine, File No. M-1981-185, Violations MV- <br />2009-035 and MV-2010-001. <br />(C) If Wildcat Mining fails to obtain the approval of the Division for the Idaho Mine <br />application, File No. M-2010-003,by June 9, 2010, the Division will so inform the Board at <br />the Board's June 9, meeting and request that this matter be set for forfeiture of the <br />$56,233 financial warranty at the Board's July 14-15, 2010 meeting. <br />3. The cease and desist order the Board imposed in its December 10, 2009 Order for <br />Violation MV-2009-033 shall remain in full force and effect except as follows: <br />(A) Wildcat Mining may use the unpermitted road only to respond to adequacy issues the <br />Division raises concerning the road stability demonstrations for the Idaho Mine application, <br />File No. M-2010-003;
