Below <br />is your requested summary. <br />In addition, given that these proceedings involve multiple permit applications and four <br />violations, this letter also includes background information on both sites. <br />Background Information for Idaho Mill, File No M-2006-069 <br />On September 26, 2006, Wildcat Mining Corporation ("Wildcat Mining") filed with the <br />Office a 110(2) application for the Idaho Mill, File No. M-2006-069. After a lengthy review <br />period of 163 days, the Office approved M-2006-069. Wildcat Mining failed to submit the <br />required financial warranty and, therefore, the permit was never issued. <br />On or about December 2, 2008, Wildcat Mining re-noticed the application, as required by <br />Rule 4.1(2), and the Office scheduled the application for consideration during the February <br />11, 2009 Board meeting. However, prior to the hearing the Office discovered that Wildcat <br />had constructed a new access road to the site and had thereby commenced the mining activity <br />prior to the issuance of the permit. The Office scheduled the possible violation for <br />consideration during the February 11, 2009 Board meeting. <br />During the February 11, 2009 hearings, the Board found Wildcat in violation for mining <br />without a permit (Violation MV-2009-007), and denied Wildcat's request for re-approval of <br />M-2006-069 application because the application was no longer adequate for approval.
