Martin <br />Executive Director <br />Loretta E. Pineda <br />Director <br />We have received your minor revision application to revise your permit to conduct coal mining in <br />Colorado. Our initial review indicates that all preliminary items required by the Colorado Surface Coal <br />Mining Reclamation Act, Section 34-33-101 et seq., C.R.S., have been submitted. Thus, your application <br />has been considered complete for the purposes of filing as of May 27, 2010. All review and comment <br />periods as provided in the Act and the Regulations initiate from this date of filing. <br />The Division is currently reviewing your revision application to determine whether the items you have <br />submitted are adequate in terms of meeting the requirements of the Act and Regulations. As indicated in <br />your email today, the figures for affected area acres shown on the decision forms for PR-10 and PR-12 are <br />significantly larger than the land area which is located above the underground workings as it is shown on <br />the E-Seam mine plan map (Map 51) that currently is in the permit application and was submitted in MR- <br />365. DRMS is reviewing this difference in affected area acres, and the conformance of the affected area <br />acres to the definition of "affected area" in Rule 1.04(7).
