III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a complete inspection and a surety release/termination of jurisdiction inspection of the Arness <br /> McGriffin Mine conducted by Tom Kaldenbach of the Colorado Division of Reclamation, Mining and <br /> Safety. Christy Hulsman and Jim Fulton represented the USDOI Office of Surface Mining. No one <br /> else was present. <br /> The permit for this mine was revoked more than 10 years ago. DRMS's IML program had reclamation <br /> work done on the site in April 1990. DRMS reduced annual inspection frequency for this site to one <br /> complete inspection and three partial inspections in 2007. <br /> The disturbed area consists of a portal face-up area for an underground mine that was eventually was <br /> not developed. A two-track dirt road crosses the site that leads to a state wildlife area. The Division <br /> of Wildlife and others maintain the road. <br /> The Division initiated the final surety release/termination of jurisdiction process for the Arness <br /> McGriffin site in 2008 by sampling vegetation on the site. Vegetation was sampled a second time in <br /> 2009. The Division had scheduled this surety release/termination of jurisdiction inspection in <br /> December 2009,but a snow storm required rescheduling. More than 50 surrounding property owners <br /> had been notified of the inspection,but none expressed an interest in attending. <br /> The ground was dry during this inspection and the entire site was accessible. <br /> Signs and Markers <br /> No signs or markers are on the site. <br /> Roads <br /> The two-track dirt road that crosses the site is to remain as a permanent feature as it provides access to <br /> a state wildlife area. Several years ago DRMS had a cable and wood post guardrail installed next to the <br /> road for public safety where the road is next to a steep slope. The guardrail appeared in good condition <br /> during the inspection. <br /> Hydrologic Balance <br /> The site has no ponds or ditches. Positive drainage exists throughout the site. <br /> Backfill and Regrading <br /> No structures remain on the site. The site's topography,blends well with surrounding undisturbed <br /> lands. No open drillholes have been found on the site during the current or past inspections. <br /> Fish and Wildlife <br /> No wildlife other than birds were seen during the bond release inspection. <br />
