RULE 2 - PERMITS <br />2.03.7 Relationship to Areas Designated Unsuitable for Mining <br />(1) Statement That the Proposed Permit is Not Unsuitable for Mining <br />The SCCC permit area is not within an area designated unsuitable for underground mining <br />activities defined in Rule 7 or 30 CFR 764 and 769 or under study for designation in an <br />administrative proceeding under Rule 7 or 30 CFR 764 and 769. <br />(2) Permit Area is Not Unsuitable for Mining Because of Legal and Financial <br />Commitments <br />SCCC claims that the proposed permit area should not be included within an area designated <br />or under study for designation in that the principal shareholder, Peabody Investments <br />Corporation, LLC has made substantial legal and financial commitments in relation to the <br />operation of PSCM. <br />(3) Ownership Waivers <br />There are no inhabitable dwellings within 300 feet of the PSCM surface facilities. <br />2.03.8 Permit Term Information <br />Below is the anticipated starting date and termination date of each phase of the underground mining <br />activities and the anticipated number of acres of surface lands to be affected, and the horizontal and <br />• vertical extent of the proposed underground mine workings, for each phase of mining and over the <br />total life of the permit. <br />(2) Number of Acres, Starting and Termination Dates of Each Phase <br />The anticipated starting date for the underground mining activities is June 2011. <br />Total acres in the PSCM permit area affected previously by surface mining activities: 2,024 <br />acres <br />Total surface acres to be disturbed (incidental to PSCM underground mining activities): 276 <br />acres <br />Total potential surface acres to be affected (worst - case): 2,816 acres (includes 3 degree angle <br />of'draw around underground mining sections) <br />Year 1 — 2,215 acres (includes 2,024 acres disturbed by surface mining activities) <br />Year 2 — 246 acres <br />Year 3 — 219 acres <br />Year 4 — 136 acres <br />Year 5 — 0 acres <br />• The first five (5) year term is depicted on Map 2.05.3 -M2, Mine Plan Map, as presented and <br />discussed in the Operations Plan Section (2.05.3). <br />PSCM Permit App. 2.03 -17 Revision 03/05/10 <br />
