III. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.Jim Kiger represented the <br /> operator.There had been recent rains and it was raining a little during the inspection. <br /> Roads <br /> The paved entrance road was in good condition.No coal fines had been tracked onto the highway.The east side <br /> gravel road also was in good condition and the east side gate was open.The railroad track light use road was wet <br /> but was passable. <br /> Sites and Markers <br /> The mine identification signs were up at the main entrance,east entrance and near the railroad tracks.The <br /> required loadout information was on each sign. <br /> Facilities <br /> Rail cars were being loaded during the inspection.No coal trucks were unloading,however.There was a fair <br /> volume of coal and coal fines that were stockpiled on the facilities bench.No problems with fugitive dust were <br /> observed,however. <br /> No problems were observed with the loadout office, substation,coal handling structures,fuel facility and the <br /> material storage area. <br /> Topsoil Stockpiles <br /> The east side topsoil stockpile had a good vegetative cover. Signs were up. The collection and diversion ditches <br /> associated with the east side topsoil stockpile were well vegetated.The west end topsoil stockpile was well <br /> vegetated.Topsoil signs were also up on this stockpile. <br /> Hydrology <br /> The west side dugout pond was dry. The combination open channel spillway was clear of any debris.There was <br /> a little standing water in the east side sediment pond.Discharge structures were functional.The embankment <br /> was stable.The collection ditches on site had sufficient capacity. <br /> Noxious Weeds <br /> The operator is preparing to spray for whitetop,which is starting to appear on site. <br /> c:/word2007/terror/insp0510 <br /> OX <br />
