M. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection conducted by Joe Dudash of the Colorado DBMS. Bill Bear represented the <br />operator, Bowie Resources LLC. The operator has suspended longwall mining until approval is issued for <br />mining in the west expansion area. In the meanwhile, Bowie is doing development mining. <br />Main Mine Site <br />The mine id sign was up at the main entrance. There was only a small volume of coal that was stockpiled on the <br />coal stockpile bench adjacent to the highway. No coal dust was going offsite and no coal fines were being <br />tracked onto the highway. Pond B had a little standing water in it. The spillways were functional and the pond <br />embankment appeared to be stable. Ditches and culverts that bring runoff into pond B were functional. <br />Riprapped ditch sections were intact. The highway ditch next to the coal stockpile bench had been recently <br />cleaned out. <br />The paved haul road up to the D-seam portal bench was in good condition, although the top curve has not been <br />repaved yet. There was a small volume of stockpiled coal on the D seam portal bench. There were no problems <br />with any of the facilities, including the fuel barn. Cut and fill slopes were stable and surface disturbance markers <br />were up around the disturbed area. The main topsoil stockpile was well vegetated and had the proper signage. <br />Coal Waste Stockpiles <br />The road to the coal waste stockpile area was a little muddy from a very recent rain but was passable. The <br />contractor has been working on the pile to steepen the outslope, as approved, in order to allow for more storage. <br />The contractor is doing a good job of eliminating pooling of water on the pile and maintaining positive drainage. <br />Along the haul road route, pond C had water close to the primary. Pond D did not have any standing water in it. <br />Spillways were functional. The gob pile topsoil stockpile was well vegetated and had the topsoil sign on it. <br />Hubbard Creek Fan Site <br />The road up to the site was in good condition. The fan was operating. Mine id signs, stream buffer zone signs <br />and surface disturbance markers were up. The upland diversion ditch was in place. The operator has graded over <br />the original entrance road to the pad in favor of the north entrance. Straw bales and straw waddles have been <br />placed on the lower end of the pad for sediment control. <br />Unit Train Loadout <br />There were some loaded railcars on site but no loading operations were taking place. No problems with fugitive <br />dust were observed. The mine id sign was up at the entrance and surface disturbance markers were up around <br />the area. The ladout bench outslopes were well vegetated. Pond J was dry, while pond K had a little water in it. <br />The pond embankments appeared to be stable. <br />c:/word2007/bowie2/insp0510
