M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the operator <br /> during the field inspection.There was no activity at any of the sites.There had been very recent rains. <br /> Unit Train Loadout <br /> All three entrance gates were open and each gate had a mine id sign in place on the fence.The paved entrance <br /> roads were in good condition.Mine equipment was being stored on site but there were no railcars or activity on <br /> site.There were no problems with the storage of the mine equipment. <br /> The sediment control system was in place.The west side collection ditch was recently cleaned. The upland <br /> diversion ditches and culverts located in the central portion of the loadout site were function.Upland runoff was <br /> passing successfully through the diversion system. There was no standing water in the sediment pond on the <br /> east side of the loadout.The bin wall of the pond was stable.The upland diversion ditches and culverts above <br /> the pond were in place and were functional. <br /> The outslope of the facilities bench was well vegetated and stable. The topsoil stockpile on the west side of the <br /> site had a good vegetative cover. The topsoil sign was up on the stockpile.No problems were observed with the <br /> railroad track spur line. Surface disturbance markers were up around the disturbed area. <br /> Well Field <br /> Steven's Gulch road was in good condition.Mine id signs were up at the appropriate locations along the road. <br /> The two subsidence warning signs were also up along the road next to the well field. <br /> The dirt road into the well field area was dry and in good condition.The mine id sign was up at the entrance.No <br /> problems were noted with the well and pump house.The former topsoil stockpile footprint was well vegetated. <br /> Reclaimed Run-of Mine Stockpile <br /> The site has a good vegetative cover. Several of the silt fence panels will need maintenance soon,however. <br /> There were no signs of slope instability or erosional gullying with the backfill.The sediment pond had a little <br /> standing water in it.The entrance road was in good condition.The cable was strung across the road.The mine id <br /> sign was off of its post and should be put back up. Surface disturbance markers were up around the site. <br /> West Mine <br /> The road to the West Mine was passable,although quite a few small rocks were scattered across the road from <br /> the hillsides above.The mine id signs were up,as were the surface disturbance markers around the reclaimed <br /> mine site.There were no indications of erosional gullying or slope instability with the backfilled areas.There <br /> was no standing water in either of the two sediment ponds.The spillways were functional and pond <br /> embankments were stable. <br /> c:/word2007/bowie 1/insp0510 <br />
