M. COMMENTS-COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made during the <br /> inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br /> evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Joe Dudash of the Colorado DRMS.No one represented the <br /> operator,Bear Coal Company,during the field inspection. There was no activity on site. <br /> Roads <br /> The paved entrance road was in good condition.The cable guard was up on the outside edge of the road.There <br /> was some debris from the adjacent property but it did not block the road.The bridge across the North Fork of <br /> the Gunnison River was passable. <br /> Signs and Markers <br /> The mine identification sign was up at the top of the hill.The correct information was on the sign. The records <br /> location sign was also up at the same location.The"no trespassing"sign was on the entrance gate. <br /> Hydrology <br /> The sediment pond had some standing water in it.The water level was about one foot below the primary <br /> discharge pipe.The gated valve on the discharge pipe was in the closed position.The emergency spillway had <br /> enough capacity. The collection ditch leading into the sediment pond had enough capacity. <br /> The hillside spring water treatment pond was discharging at about 10 gallons per minute.The color of the <br /> discharge water was orange,which has been found in the past to be in compliance with water quality standards. <br /> The riverside berm was in place next to the river. <br /> Reclamation <br /> The reclaimed road up to the reclaimed fan area was well vegetated and appeared to be stable.The same was <br /> true of the reclaimed fan site.The west side portal reclamation work continues to be unstable. <br /> c:/word2007/bear3/insp0510 <br />
