III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br /> Reclamation, Mining, and Safety (Division). Activity has again increased since the last <br /> inspection with many vehicles noted parked near the industrial building and a steady stream <br /> of workers and contractors entering and leaving the site. Ground conditions on this day were <br /> excellent and the weather was overcast and cool. <br /> Signs and Markers <br /> The operator should repaint and/or replace, as necessary, disturbed area markers that are <br /> found at the perimeter of the reclaimed area. Page 2.05-5 of the approved permit reads as <br /> follows: <br /> "Maps 15 and 16 show disturbed areas on the site. The disturbance area boundary has <br /> been established to include a buffer should additional disturbance activities become <br /> necessary. The surface disturbance boundary shown on maps 15 and 16 will be the <br /> boundary marked in the field in accordance with Rule 4.02. These markers will consist of <br /> roofbo/ts or rebar covered with white PVC pipe. As portions of the site are reclaimed <br /> boundary markers will be moved to the reclamation limits of the disturbed areas." <br /> Please ensure that the boundary is marked so that adjacent markers are visible in both <br /> directions when standing at any marker. Comers should always be marked and where <br /> reclamation areas are immediately adjacent to the disturbance boundary as shown on Map <br /> 15 and Map 16, the reclamation area boundary supersedes the map boundary. <br /> Roads <br /> The operator continues to improve and reshape roads over the entire site. Berms have been <br /> established on light-use road immediately south and east of the thickener tank on the way to <br /> pond 7(shown at right). The operator ;B <br /> should review the approved network of <br /> roads as shown on Map 11 in light of plans <br /> to restart coal production in the near future. <br /> Haul roads are required to transport coal <br /> and coal mine waste. Coal and coal mine <br /> waste cannot be hauled on access or light- <br /> use roads. <br /> Hydrologic Balance <br /> Pond 7 remains nearly full. The outlet gate <br /> was closed. Water in the pond appeared <br /> slightly murky, likely due to recent rainy <br /> weather. Please ensure that the pond is brought into compliance with the approved plan <br /> (see approved permit page 2.05-10a). <br /> From review of the permit and Exhibit 19 (hydrologic exhibit) it is not clear what the design <br /> 3 <br />
