III. COMMENTS - COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection conducted by Kent Gorham of the Colorado Division of <br />Reclamation, Mining, and Safety (Division). This mine site has completed reclamation of <br />disturbed areas, excluding ditches and sediment ponds. Ground conditions were excellent <br />and the weather was partly cloudy with a storm brewing later in the inspection. <br />Hydrologic Balance <br />Pond 8 is dry. Any plans for clean-out should be implemented as soon as possible. The <br />sediment marker remains on the embankment of pond 9a (Jeff Canyon side) awaiting <br />installation. Please ensure that all markers are installed on a timely basis as pond conditions <br />allow. Rills and gullies appear fewer in number, possibly due to improved vegetative cover at <br />the site. Repair work to ditches as previously noted has yet to be completed. <br />Revegetation <br />The growing season has finally arrived as grasses, forbs, and weeds respond to warming <br />conditions after an extended winter season. Western wheatgrass leads the way, with <br />sprouting of the forbs cicer milkvetch and alfalfa also noted. A pedestrian survey around the <br />site resulted in the following series of photographs of areas identified as labeled on the 2008 <br />Annual Reclamation Report, Map ARR-1. <br />3 <br />Above: Area N-1 looking to the east from undisturbed hillside
