III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete coal inspection conducted by Jason Musick of the Colorado Division of <br />Reclamation, Mining, and Safety (Division) on 19 May 2010. Records were accessed at the <br />HGTI/Seneca Coal Co. office, located at the loadout. The site is an inactive loadout with no activities <br />being conducted at the time of the inspection. The weather was cloudy and the ground was wet <br />during the on-the-ground inspection of the site. <br />Availability of Records <br />See attached DRMS Availability of Records. All records were located at the HGTI office. The air <br />emissions permit and the Routt county special use permit have expired (8/23/2008 and 2/3/2008). No <br />activity is occurring on the site. <br />Signs and Markers <br />The mine I.D. signs were in place at the appropriate locations. All mine I.D. signs were in compliance <br />with all required information with no problems noted at the time of the inspection. <br />Hydrologic Balance <br />The truck loop pond (pond 1) was holding water with no discharge noted. The embankments <br />appeared to be stable and well vegetated with no problems noted. The primary spillway appeared to <br />be functioning as permitted with no problems noted. <br />The rail loop pond (pond 2) was holding water time of the inspection. The embankments appeared <br />stable and in compliance at the time of the inspection the primary spillway was functioning as <br />permitted with no problems noted. <br />Ditches were functioning as permitted with no problems noted. No evidence of damage was <br />observed. <br />Support Facilities <br />The area in and around the support facilities appears stable. No activity has occurred at the site with <br />the exception of the following: <br />Asbestos removal was conducted in the crusher and loadout buildings. HGTI personal supplied a <br />copy of the final project summary to the Division during this inspection.
