IV. ENFORCEMENT ACTIONS The following identifies enforcement actions taken during this inspection, the required abatement and date of abatement for the violation, previous violations still requiring abatement and the termination of violations cited during previous inspections. NOV CV-2010-002 is issued for failure to use approved seed mix in violation of Rule 4.15.1(2). The approved Seed Mix#8- Dryland Pasture does not include forage kochia or fourwing saltbrush. Both of these species were observed in the reclaimed areas north of BB road. Since the species have already germinated and are growing, there is no on-the-ground abatement required. The 2009 Annual Reclamation Report was reviewed to check seed mixes planted and the seed tags for each mix planted last year. The seed mix used last year was not identified and there was no seed tag, invoice or other documentation showing what species were planted. This documentation is required by Rule 2.04.13(1)(e) and must be provided by June 1, 2010. Additionally, the abatement for the NOV will require WFC to submit a minor revision to the permit. In the permit, WFC must commit to provide in the Annual Reclamation Report, the species, location and number of acres of vegetation planted during that year, including any augmented seeding or cultural practices. WFC must indicate discrete areas planted with specific seed mixes, and seedtags, invoices or other comparable documentation must be included for each seed mix used.
