III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a Complete Inspection of the Hamilton Mine conducted by Marcia Talvitie of the <br />Colorado DRMS beginning at 10:45 a.m. on Wednesday, 28 April 2010. No representative of the <br />operator was present during the inspection. Skies were clear, with high winds blowing. The <br />inspection began with a review of the permitting records. The field portion commenced at 11:30 <br />a.m. <br />Permitting Actions <br />Progress on TR-09 (Pond B - Permanent impoundment) was stalled throughout the winter, <br />awaiting the sampling and laboratory analysis of impounded water this spring. The <br />Decision Due date of April 30th will need to be extended and an alternate means of <br />evaluating the quality of water in Pond B will need to be proposed. <br />• The bond release inspection for SL-02 (Phase II Bond Release) will be conducted on 3 <br />June 2010. <br />Availability of Records <br />• Mine records were available for review at the office of the Broad Canyon Landfill. The <br />landfill was closing for the day, just as I arrived, due to the extremely windy conditions. A <br />completed DRMS Availability of Records Form is enclosed with this report. <br />Roads <br />• Roads throughout the permit area were dry; both ponds and mining areas were easily <br />accessible by vehicle. <br />Hydrologic Balance <br />• Sedimentation Ponds A and B were both completely dry, as they have been throughout <br />the past winter and spring. <br />Revegetation <br />• Big sagebrush, which is prevalent throughout the undisturbed areas, exhibited vigorous <br />spring growth (Photo 1), while the fourwing saltbush, included in the seed mix for the <br />reclaimed areas, had not yet begun to leaf out (Photo 2). <br />Fourwing saltbush plants were observed to be providing a protective environment for the <br />establishment of grasses beneath their branches (Photo 3). <br />Reclamation Success <br />The fence surrounding Mining Area No. 3 was open at the southeast corner, and <br />evidence of cattle activity was observed along the reclaimed former haul road bed <br />inside the fenced area (Photo 4). <br />This concludes the inspection report for the Hamilton Mine. <br />Hamilton Mine C-1991-078 28-Apr-2010
