III. COMMENTS - COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> Revegetation <br /> Revegetation observations were limited due to the early stage of the growing season. Revegetation operations <br /> in 2009 were primarily associated with gully and slide repair, construction of erosion control surge structures, and <br /> similar maintenance sites. Additional tree and shrub plantings were also conducted in various locations. In 2009 <br /> seeded areas, cover crop species had recently emerged in some locations, but not others, depending on slope <br /> exposure and elevation. Revegetation success on older reclaimed areas is variable across the site. Seedling <br /> big sagebrush are evident in significant densities in numerous locations in the South Extension area, where <br /> mountain big sagebrush has been included in the standard rangeland seedmix. <br /> Weed control operations are a continuing aspect of the revegetation plan. High density patches of Canada <br /> thistle were noted in a couple locations during the inspection, and will need to be sprayed in accordance with the <br /> approved plan. The patches were along Channel 006-S1 in the fenced shrub area, and on the north side of <br /> Topsoil Stockpile XX, which is located above Road "J", north of Pond 016. <br /> There were very high winds on 4/28, particularly along the ridgeline, and it was noted that weed fabric strips had <br /> pulled up and were flapping in the wind within the large fenced tree/shrub area on the ridgeline. This location <br /> and other planting sites where weedguard fabric was used should be checked and the weed fabric <br /> repaired/replaced as warranted. <br /> Topsoil <br /> Remaining topsoil stockpiles and former stockpile sites were in general stable with adequate vegetation cover. <br /> A heavy thistle infestation was noted on Stockpile XX, which will need to be sprayed. Certain stockpile sites <br /> including AAA and DDD in the South Extension could not be accessed due to ground conditions. Maintenance <br /> of sediment berms and/or installation of silt fencing or straw wattles is warranted at Stockpiles XX and <br /> CCC. <br /> Fish and Wildlife <br /> A male dusky grouse exhibiting mating display was observed along reclaimed Road "I"on the afternoon of 4/28, <br /> and several dusky grouse were flushed along the northern perimeter of the"D" pit reclaimed highwall slope on <br /> the morning of 4/27. <br /> 8 <br />
