p.5 <br />from Federal and State laws, the State used this 1978 obsolete document OVER the National soil <br />Survey Handbook, over and BEYOND All of the rules and regulations. How can you even <br />permit something like that or even Mr. Berry??? <br />Page 4.Again the State makes it known that in Stipulation No. 17 that the entire 107.96 acres will <br />be returned to cropland, prime farmland unless it does not meet the criteria Prime B ? the sta. e <br />which it does in ALL rules and regulations governing it. BY NRCS, By WFC and again Marcia gives WFC a chance to try and disprove prime farmland. The laws state that <br />this MUST ALL be decided BEFORE THE MINE CAN MINE. So, Why is the state or the <br />Federal government allowing them AS ASTILL LREADY BEEN COMMITTED TO IN THE COVER <br />done and PRIME FARMLAND <br />LETTER OF TR57 and by the STATE and by NRCS? If they do not want to stick to the <br />committment that ALL of this is PRIME FARMLAND as it is documented since 1973 and on, <br />then WE DO NOT WANT THEM TO MINE ANY MORE. If you need a signed letter from Mr. <br />Morgan, then I will get it for you. If they are not going to put it back in. irrigated cropland all of <br />it, then we do not want them mining anymore. If this means going to the district court or the <br />federal court and get an injunction until this prime farmland is addressed properly, I guess we <br />will do that. If the laws, rules and regulations cannot be followed, then. we do not want the mine <br />here. This is all prime farmland and we are very adversely affected when they are trying to take <br />away our livelihood. We produce CROPS, we have no need for pasture or dryland. We cannot <br />use either. The state and WFC are so afraid that since WFC stole our prime soils that there is no <br />way that this place can ever meet bond release with what is left. That is the real reason they are <br />fighting so hard. Marcia, herself state in TR57 and in PR5 that the WFC portion is considered <br />prime farmland because NRCS said it was historically irrigated and cropped but not ours, and <br />then when NRCS says ours is< ALL of them FIGHT us. <br />Our prime farmland has been historically used fro crops for 50 years. <br />Our prime farmland has slopes less than 6 % we have 1 to 3 <br />Our prime farmland soils were prime and had no rocks and up to 72 inches deep <br />Our prime farmland had a growing season of more than 90 days <br />our primefarmland had Barx Darvey soils until they stole them and put them on Bensons. <br />Our prime farmland has and had a dependable and adequate water supply. One that is good 8 out <br />of 10 years and Mr. Morgan is the largest stockholder and has historically irrigated and cropped <br />this place since 1959. And NRCS has documentation since 1973. Or maybe we should find <br />some obsolete document and use it, by the way I have one from the USDA from 1985 showing it <br />was primefarmland. <br />Our prime farmland was the very best in this country and always in cropland prior to the mine <br />entering the property!! f 1 We had all of our irrigation in place and this can never be again by the <br />way they are putting it back. This is why we need you to come and tour WITH US. We can <br />show these things, we cannot show you by writing. We have the rights to" show" by all of your <br />laws. Mr. Berry said he would come and never did. <br />Page 9. The data that is listed in 1998/1999 STUDYS. WHERE DID THIS INFORMATION <br />COME FROM?????? If you look at the soils map and the soil samples and the information from <br />NRCS , this is an outright LIE. Our BARX DARVEY SOILS were an average depth of 54
