The Federal and State laws <br />are designed to protect the landowner and ALL Prime farm lands. The individual should not <br />have to learn the laws nor should they have to ever file an objection. ][he laws were designed <br />because of the mining industry always doing what ever they wanted to. So, in 1977, laws were <br />put in force by President Carter so that any land being disturbed by a raining operation would be <br />returned to as good as or better conditions than it was before the mine entered the property. In <br />these laws prime farmland required special considerations and special requirements that were not <br />met. The landowner is suppose to be kept informed of any and all changes made to his property. <br />Because of the disregard that has happened to this prime farmland, now the STATE is backing <br />the mine and the. Federal Government is backing the State because None of you know how to fix <br />what has happened. <br />Where did Mr. Berry get the idea that a side roll is an UPGRADE??? We cannot raise corn or <br />sunflowers under it and it uses more water than what we were using prior to the mine entering <br />the property on the Sunshine place. So, how is that an upgrade? We bought our side rolls in <br />1996 before the mine ever signed the lease with Mr. Morgan and we bought the first pivot in 1991 <br />before the mine was even here. And, we bought the second pivot in 11996, again before the mine <br />signed the lease with Mr. Morgan. The GATED pipe was first bought by Aunt Gracie whenever <br />Michael was in high school, 1000's of feet and Michael is 54. Morgans bought 1000's of feet <br />more years after Michael was out of high school. At least I would hope that the Administrator <br />would have his facts right. Obviously not. And by the way, the mine; hasn't been here even 20 <br />years and we have been here our entire lives and Michael was born in this same house. <br />Mr. Fulton made a decision without ever talking with us here, without us ever being able to show <br />him the things that can't be shown on paper and so did Mr. Berry. So, we are absolutely <br />objecting until one of you come here so that we can show you lots of things before it is too late to <br />correct. Then, the only thing left is a lawsuit.
