Please <br />be advised that if you are unable to satisfactorily address any concerns identified in this <br />review before the decision date, it will be your responsibility to request an extension of the <br />review period. If there are outstanding issues that have not been adequately addressed <br />prior to the end of the review period, and no extension has been requested, the Division will <br />deny this application. <br />6.4.4 Exhibit D - Mining Plan <br />1. The Applicant has stated downcutting of the streambed will be controlled with grading and <br />riprap. In the Division's experience, this method is not sufficient to prevent downcutting. The <br />Division is concerned that mining within Rock Creek could impact County Road 55 and <br />County Road ZZ. Since the Applicant is also the owner of County Road 55 and County Road <br />ZZ, the Division would accept a signed and notarized letter from the Washington County <br />Road and Bridge District 2 or the Washington County Commissioner stating the Applicant <br />would be responsible for any dam?ge that occurred to County Road 55 or County Road ZZ as <br />a result of mining or reclamation activities. <br />As previously mentioned, if you are unable to provide satisfactory responses to any inadequacies <br />prior to May 23, 2010, it will be your responsibility to request an extension of time to allow <br />for continued review of this application.
