Please revise Section 2.04.7(3) on revised pages 2.04-49 and 2.04-50 to include the possible impacts <br />from mining the B-seam. <br />24. In the second paragraph on revised page 2.04-50, should Terror Creek be included along with <br />Hubbard Creek and Steven's Gulch as creeks that will be protected from the effects of subsidence? <br />25. On revised page 2.04-47, it is stated that stock pond P-1 is located in Steven's Draw in the southwest <br />corner of the permit area. With the additional acreage added in PR-12, the location of PR-12 is more <br />south centrally located. In order to avoid any confusion, please revise accordingly. <br />26. On revised page 2.04-49, there is a discussion concerning the potential for degradation of water <br />quality and water quantity from the mining of the D-seam. However, there does not appear to be any <br />similar discussion of potential degradation from the mining of the B-seam. Please provide this <br />discussion. <br />27. In the second paragraph on revised page 2.04-50, it is stated that Hubbard Creek and Steven's Gulch <br />will be protected from the effects of subsidence. Considering that Steven's Gulch is at the end of the <br />longwall mining in panels B-10 and B-11, can Steven's Gulch be protected from subsidence or will <br />the subsidence effects be mitigated? Please revise if appropriate. <br />Section 2.04.9 Soils Resource Information <br />28. As BRL is aware, with any future surface disturbance, such as with methane degas facilities within the <br />proposed west mine expansion area, BRL will need to submit baseline soils information for the <br />proposed disturbed areas before approval of such facilities can be made. <br />Section 2.04. 10 Vegetation Information <br />29. As BRL is also aware, the operator will need to submit baseline vegetation information for those areas <br />proposed to be disturbed within the west mine expansion area, such as with methane degas wells. <br />Section 2.04. 11 Fish and Wildlife Resources Information <br />30. With the proposed west mine expansion, please revise, if appropriate, the water depletion estimate <br />found on revised pages 2.04-85 and 2.04-86. <br />31. BRL will need to submit information on the fish and wildlife resources as required in Rule 2.04.11 <br />and in consultation with the Division, for those areas in the west mine expansion area where surface <br />disturbances will be proposed in the future.
