III. COMMENTS -COMPLIANCE <br /> Below are comments on the inspection. The comments include discussion of observations made <br /> during the inspection. Comments also describe any enforcement actions taken during the inspection <br /> and the facts or evidence supporting the enforcement action. <br /> General Mine Plan Compliance <br /> • The mine shovel was excavating blasted overburden from the WFC parcel and <br /> loading it into mine haul trucks for transport to the back side of the open pit. Two <br /> bulldozers were in the immediate vicinity, apparently pushing material toward the <br /> shovel (Photo 3). <br /> Revegetation <br /> • The Irrigate Pasture reference area is situated immediately east of topsoil stockpiles 1, <br /> 3, 4 and 5,just outside the permit boundary (Photo 2). <br /> • A portion of the reclaimed Lloyd property (proposed Irrigated Pasture postmining <br /> land use) was seeded with winter wheat the previous fall (Photo 4). <br /> Prime Farmlands <br /> • There were no active operations occurring on the Prime Farmland (Morgan property) <br /> at the time of the aerial inspection. <br /> • As illustrated in Photo 5, a succession of benches has been established with the <br /> phased removal of Lift A and Lift B topsoil and Bench 1 material. Lift A and Lift B have <br /> been stockpiled separately, as shown in the lower right-hand corner of the photo. <br /> • A large area of Bench 1 material has been replaced and regraded immediately east <br /> of the active pit (Photo 5). <br /> • The topsoil stockpiles throughout the permit area, including the Lift A, Lift B and Mixed <br /> piles on Morgan property, had been recently hydro-seeded (Photo 6). <br /> This concludes the aerial inspection report for the New Horizon Mine. <br /> New Horizon Mine C-1981-008 27-Apr-2010 <br /> -2- <br />
