Jackson County authorized Speicial Use Permits for Mineral Extractive Operations - <br />Open Cut Coal Mining at the Kerr Marr Mine site by the adoption of Resolution No. 1975-xi-17 on the 17th day of <br />November, 1975 and again by Resolution No. 1980-xi-10(b) adopted on the 10th day of November, 1980. The Special <br />Use Permit authorization issued pursuant to the resolutions set forth herein, were to terminate upon a finding by the Board <br />of County Commissioners that commercial production on the permit tract had ceased for a period of one (1) year, <br />unless an extension was otherwise authorized by the Board. To date, the Board of County Commissioners has not made <br />an official finding to terminate the SUP authorization because there is on-going reclamation at the Marr mine site. As I <br />had indicated to you in our telephone conversations, Jackson County has no problems with any activities or work being <br />conducted by Kerr Coal Company at the Marr Mine site or at the Loadout site. The loadout site was rezoned from <br />Ranching District to Industrial District on July 29, 1974 to allow the loadout facilities and activities as Uses-by-right in <br />the Industrial District zone in Jackson County. This loadout site is still zoned Industrial. If you need additional information, <br />please contact me at your earliest convenience. <br />Wm.
