Notice of Proposed Decision <br />The Colorado Division of Reclamation, Mining and Safety has issued a proposed decision to Approve <br />Bond Release Application No. 2 (SL-2) for the Seneca II-W Mine, Permit No. C-1982-057. The mine is <br />operated by Seneca Coal Company, LLC under the provisions of the Colorado Surface Coal Mining <br />Reclamation Act. The bond release application was submitted by Seneca Coal Company, LLC on August <br />17, 2009. Seneca Coal Company, LLC submitted a request for Phase I Bond Release on 1,166.2 acres of <br />regraded lands within the Seneca II-W permit area. Of the 1,166.2 acres requested for release, the <br />Division proposes to release 721.9 acres of the disturbed/reclaimed land that has been regraded to <br />approximate original contour. Specifically excluded from the Phase I bond release decision are 402.85 <br />acres in the South Extension Area, 10.0 acres for the Pit A highwall, 0.59 acres for drainage channel <br />reconstruction, 0.03 acres for the Culvert I-1 area, 12.1 acres for a scraper road, and 18.7 acres for roads <br />where as-built certifications are needed. The Division is proposing to release $2,038,488.00, from the <br />total bond amount of $11,117,348.00. The permit area is located approximately seven (7) miles south of <br />Hayden, CO, off Routt County Road #53. The affected area is located in Routt County, approximately 9 <br />miles South of Hayden, Colorado. <br />Copies of the proposed decision are available for review at the Colorado Division of Reclamation, Mining <br />and Safety office, 1313 Sherman Street, Room 215, Denver, Colorado 80203, and at the office of the <br />Hayden Public Library. <br />Any person who has an interest which is or may be adversely affected may request an adjudicatory <br />hearing regarding this proposed decision. Requests for a hearing must be made in writing within thirty <br />(30) days of the first publication of this notice, and shall state with reasonable specificity the reasons for <br />the request and objections to the proposed decision.
