This revision was received on 29 December 2009, <br />deemed complete on 8 January 2010 and is under review by the <br />Division. <br />Technical Revision 85 - This revision proposed an updated reclamation cost estimate for <br />the Colowyo Mine. The revision was received on 18 February 2010 <br />and deemed incomplete on 1 March 2010. <br />Section III - Status of Stipulations <br />According to the Division's records in the permitting system database, there are five <br />outstanding stipulations attached to Permit No. C-1981-019. These stipulations are listed <br />below. <br />Stipulation 2 Prior to disturbing any lands in the Lower Wilson area, the <br />Colowyo Coal Company shall provide the Division with a <br />PERMIT revision containing a mine plan and a reclamation plan <br />and any additional baseline monitoring information (surface water, <br />ground water, soils, vegetation, etc.) requested by the Division. <br />The approval of Permit Revision 02 is only an approval for <br />disturbance in the South Taylor Pit (South Taylor Pit, West Valley <br />Fill, East Valley Fill and associated structures). NO <br />DISTURBANCE IS APPROVED FOR THE LOWER WILSON <br />AREA WITH THE APPROVAL OF PERMIT REVISION 02. <br />Stipulation 3 Prior to disturbing the Lower Wilson area the Colowyo Coal <br />Company shall perform further archaeological investigations on <br />seven areas identified as requiring more detailed study in the <br />October 1984 report titled "Cultural Resources Investigations in <br />the Danforth Hills Proposed Coal Lease Area; Moffat and Rio <br />Blanco Counties, Colorado; Consolidation Coal Company. These <br />areas are as follows: 5MF1652, 5MF1935, 5MF1937, 5MF4003, <br />5MF4010, 5MF4011 AND THE Bison BoneIN THE CUT-BANK. <br />The additional study data will be forwarded to the Colorado <br />Historic Society for their evaluation and a determination of the <br />proper course of action required. <br />Stipulation 4 Prior to disturbing the Lower Wilson area the Colowyo Coal <br />Company shall perform further archaeological investigations on <br />the six areas identified on Map 16A as "unsurveyed areas". <br />Additionally, Colowyo will be required to survey any other areas <br />that are determined to have no survey or inadequate survey data. <br />The six unsurveyed areas shown on Map 16A are all within <br />Township 4 North Range 93 West and are basically described as <br />follows: <br />Colowyo Mine <br />Permit No. C-1981-019 <br />2010 Midterm Review <br />10 May 2010 <br />5
