The most recent <br />analytical laboratory reports are enclosed with this letter as an attachment. <br />CEMEX continues to monitor the water elevation in the C-Pit pond visually after the data logger <br />recording head became unusable and was removed from the pit in June 2009. C-Pit water has <br />not been used in the plant process since October 7, 2009. Water levels in the first quarter of 2010 <br />showed a rise of approximately four feet over the fourth quarter of 2010. A new pump is being <br />added to C-Pit, and the water used for dust suppression with in the pit. <br />In-flow of water through the west high wall in C-Pit has not been observed during the first <br />quarter of 2010. Water continues to be present in some of the pieziometers placed between the <br />canal and C-Pit, but was absent in those located between the Sweede Ditch and the pit. We are <br />working with Northern Colorado Water Conservancy District (NCWCD) to have the bend of the <br />supply ditch lined before the 2011 irrigation season. Based on observations and other data, it is <br />evident the majority of the source of the remaining water entering into C-Pit is from the loss of <br />bank lining at the northern bend in the NCWCD supply ditch and stormwater runoff from the <br />southwestern portion of the mine.
